​Ad-Duha’s mission is to help families provide their children with quality Islamic materials. Therefore, we ask that our customers help us by adhering to the following policies. These policies are intended to protect Ad-Duha's intellectual property (i.e., online, print, and software media) so that we can continue to develop and produce quality products for children, Insha-Allah. Only through the blessings of Allah and the support of families and organizations like your own can Ad-Duha continue to serve the Ummah.  Use of the Ad-Duha website signifies that you have read, understood, and agreed to the following.

COPYRIGHT
(PRINT & E-BOOKS)

RETAIL CUSTOMERS (FAMILIES): All Ad-Duha books (print and e-book) are copyrighted. Purchasing books entitles you to use the books in your own home for yourself and your children or to give them as gifts; it DOES NOT grant ownership of the copyright or permission to make copies of printed books or share e-book files/download accounts with others in any form, even if done for free or as a favor to family and friends.

NO SHARING E-BOOKS OR DOWNLOAD ACCOUNTS: Purchasing e-books and sharing login information or saved e-book files with others outside your home is a violation of the copyright and this terms of use agreement. Ad-Duha regularly monitors download account activity and reserves the right to close any account that exhibits unusual activity, including but not limited to downloads from multiple states, cities, provinces, countries, and/or multiple IP addresses. Additionally, requests to reset/reinstate download credits or accounts with such activity on them will not be allowed. Ad-Duha also reserves the right to block future purchases of its products by any individuals identified as violating this copyright and terms of use agreement.

NO COPYING PRINTED BOOKS: Purchasing printed books and then making copies to share with others (digital or print, in-person or online) is a violation of the copyright and this terms of use agreement. If Ad-Duha becomes aware of such activity, it reserves the right to seek legal enforcement of its copyright by all means within the law. Ad-Duha also reserves the right to block future purchases of its products by any individuals identified as violating this copyright and terms of use agreement.

Please remember that by purchasing products from Ad-Duha and honoring this copyright and terms of use agreement, you help Ad-Duha remain in business and support the development of even more products for your children and grandchildren in the future and the entire Ummah, Insha-Allah.

HOW E-BOOKS WORK: We recommend accessing the downloads on a desktop computer or laptop, as tablets and cell phones (particularly iPhones) often have issues opening the files. You can download the e-book files up to TWO TIMES, after which the download links will be deactivated.

For example, if you purchased 10 e-books, you will have 20 download credits (2 credits x 10 books). If you then proceed to download 5 books 4 times on different devices (5 books x 4 credits each), you will run out of credits before downloading all the e-book files. Therefore, we recommend downloading all the e-books immediately after purchase and saving them to a thumb drive (USB). That way, you will not run out of credits, and if you ever have to change computers or there is a hard drive failure, you will still have access to the downloaded e-books on your thumb drive. SCHOOLS & HOMESCHOOL GROUPS: For schools/homeschool groups wanting to use our products with students and or staff, we offer wholesale discounts (see the wholesale section below), making it affordable for all of your students to benefit from professionally published, high-quality textbooks, workbooks, and storybooks. 

Please remember that by purchasing books, you are supporting the development of more products by Ad-Duha that will benefit your school and schools around the world in the future, Insha-Allah.

SCHOOL COPY LICENSE: If your school cannot afford discounted wholesale books, we offer a School Copy License Agreement allowing you to print extra copies of a single set of books or e-books you purchase. The copies you make may only be used for your educational program's staff and/or officially enrolled students, and the download account login information must be held securely by a single staff member, not shared with other staff, students, or parents. SOCIAL MEDIA:  If you wish to post a testimonial or review of Ad-Duha products on your social media account/s, first of all, Jazak-Allah! Second, please limit pictures of Ad-Duha books to covers front and/or back and limit the number of sample pages (as images, not as PDF) from each book to no more than ten. If reviewing an entire book series, please limit the number of books you post pictures/sample pages to no more than five from each book series. If you are unsure if your use of the books will violate the copyright or if you would like to collaborate with Ad-Duha, contact us for further clarification or details.

Please be aware that posting Ad-Duha books online (except as mentioned above), transferring them to a third-party printer/copier to be printed, shared through email, posting to file-sharing sites/apps/services, or making additional copies (digital or print) for others (for free or for sale) is a breach of the copyright. All copyrights remain the sole property of Ad-Duha Institute. For more information on copyright law in Islaam, please see the references below (Fatwa Section).

DERIVATIVE WORKS: If you use Ad-Duha content, products, and/or services to produce a derivative work (e.g., translation, syllabus based on the Ad-Duha curriculum but rearranged differently, worksheets that use Ad-Duha illustrations or format, etc.), whether offered for commercial sale or not, you will be considered a breach of the Ad-Duha copyright and intellectual property rights. If you are unsure if your use of the books will violate the copyright, contact us for further clarification.

IDEA CONTRIBUTIONS: Occasionally, users may want to send suggestions or ideas to Ad-Duha to help improve our services and products. We welcome all suggestions for improvement and ideas for new products. However, if you submit an idea or a suggestion, you agree to the following:

  • The idea/suggestion is your own and is not anyone else's intellectual property.

  • You acknowledge that you will not claim royalties, copyright, intellectual property rights, recognition, or reimbursement of any kind if Ad-Duha uses your idea or suggestion.

  • You acknowledge that Ad-Duha will have sole and complete copyright over the idea or suggestion once you have submitted it. This will be the case whether the idea/suggestion is used at the time of submission or at some time in the future.

If you do not feel comfortable with these conditions, please do not submit your idea or suggestion to Ad-Duha. Ad-Duha receives ideas/suggestions from users all over the world. If an idea, material, product, or anything produced by Ad-Duha resembles an idea that you had but did not submit to Ad-Duha, this resemblance is entirely coincidental, and you may not claim royalties, copyright, intellectual property rights, recognition, or reimbursement of any kind if Ad-Duha for coincidental similarities. Ad-Duha strictly enforces others' copyrights and makes every reasonable effort to avoid breaching any copyright or intellectual property rights. Ad-Duha has a policy of giving credit for ideas/materials where and when appropriate.

RE-POSTING: Ad-Duha does not allow the reposting of any of its content (including purchased print books and/or e-books) on other sites on the Internet (i.e., including websites, blogs, forums, newsgroups, or any other format, private or public networks, that exist now or in the future), except in the case of a specific written licensing agreement for that purpose. Content is defined as any products, images, text, documents, formats, web pages, web designs, source code, or software; in short, anything that is on, accessible from, or purchased from Ad-Duha.

FATWA
(RELIGIOUS RULING)

Some customers have contacted Ad-Duha with questions regarding copyrights, particularly about selling products teaching Islamic knowledge. Therefore, we have posted some of the scholars' decisions (Fatwa) on these issues so that these matters can be understood based on a correct understanding of the Shari'ah (Islamic Law).

The Fiqh Council of the Muslim World League Makkah al-Mukarramah 

The author and inventor should have rights with regard to that which they have written and invented, and this right is something that belongs to them according to Shari'ah. It is not permissible for anyone to take it away from them without their permission... Similarly, neither the publisher with whom the author makes a deal nor anyone else has the right to change any of the content of the book or to change anything else without the author's consent.

Trade names, company names, trademarks, writings, and inventions are all the copyright of their owners or authors, which in modern practice have acquired monetary value. These rights are respected by Sharee'ah, and it is not permissible to transgress against them. The owner of these rights has the right to dispose of them, and no one should transgress against them.

​It is not permissible to make copies of  programs (software) whose authors have forbidden the making of copies without their permission because the Prophet (peace and blessings of Allah be upon him)  said: "The Muslims are bound by their conditions." And he (peace and blessings of Allah be upon him) said: "Whoever reaches a permissible thing first (i.e., the author/inventor) has more right to it.

​In regard to the permissibility of breaking a copyright: If the authorities (government or international law for example) forbid that (breaking the copyright), then it is not permissible because Allah has enjoined us to obey those who are in authority, except it if involves disobedience to Allah, but banning the copying of these things is not disobedience to Allah.

Undoubtedly the authors of these tapes and CDs have expended time, effort, and money to produce them, and there is nothing in Sharee'ah to indicate that they should not take the profits that result from this work. The one who transgresses against their rights is wronging them and consuming their wealth unlawfully.

Shaykh Muhammad Baazmool (Umm Al-Quraa University in Makkah)

In regards to copyrighted material being posted on the internet without the author's knowledge: The answer to this is found in what I have already said since this action of his is a kind of transgression against the intellectual property rights (copyrights) of his Muslim brother. And this action of his is similar to stealing, as this is stealing intellectual property rights (copyrights), and stealing as defined in the Shari'ah, is taking things that are valued at a quarter of a deenaar (coin, or unit money, used at the time of the prophet) or more. I say that it is upon the one who has done this action to hide this material (i.e., by removing the page), seek permission from the owner, and not publish it until after this permission is obtained.

​In regards to those who make derivative works based on the original without permission: And if he has taken some liberties with this material, making changes to it, and has acted with tadlees (deception), then this is a crime that he has committed against the owner of this material, and a transgression against the brother who did the work of translating the material and making footnotes to it, and has done an action that is not permissible.

And no doubt, the people of wara', the people of the Religion, the people of taqwa are keen to do things in a way to achieve (barakah) blessings. And blessings do not come in a thing done in this manner. So, if the information is being taken in this manner, then it will be void of any blessing.

And it is upon all of us to work hard to teach the people these affairs. And every person should respect the rights of others so that this kind of affair does not take place, as it is a form of transgression against the rights (of the people). Islam calls to the preservation of these kinds of rights, to uphold them, and to not transgress (against others) or commit crimes like these, and Allah knows best.

INFORMATION GATHERED: We collect information in two ways: optional, voluntary form submissions (e.g., contact us, reviews, email, mailing list subscription, etc.) and general browsing data collected when you access any page on our website (e.g., page clicks, type of device/ browser, region, pages visited, etc.).  

Under no circumstances does Ad-Duha Institute divulge any information about an individual user to a third party except in fulfilling the user's request for information, services or to purchase materials (e.g., we use your mailing address to ship materials via USPS,  use your e-mail address to send a bill through PayPal, or use your browsing data to improve our website services and functionality).

​Ad-Duha transmits its forms through service providers like PayPal, Square, Stripe, UPS, USPS, FedEx, Payhip, Luluxpress, Squarespace, and Wix. As with any communication transmitted over the web, a third party could intercept the information without Ad-Duha's knowledge. Ad-Duha cannot guarantee that such interception will not occur.

CHILDREN: In accordance with the Federal Children's Online Privacy Protection Act of 1998 (COPPA), we will never knowingly request personally identifiable information from anyone under the age of 13 without parental consent. 

USE OF INFORMATION: Ad-Duha uses any information voluntarily given by our users only to meet the user's specific requests (i.e., respond to a Contact Us message or provide information by standard or e-mail). Your information will not be used for advertising or marketing purposes except when subscribing to our mailing list. In this case, only you will receive messages detailing our products/services or promotional offers from time to time. Ad-Duha never shares its mailing lists with advertisers, sponsors, or partners. We will not share information about individual users with any third party except to comply with applicable laws or valid legal processes or to protect the personal safety of our users or the public.

SECURITY: Ad-Duha utilizes web service providers with secure data networks protected by industry-standard firewalls and password protection systems. GDPR (General Data Protection Regulation): In compliance with the GDPR guidelines enacted by the European Union, you may request at any time to get a complete listing of all information that our site has gathered and have that report, known as a Request to Access, emailed to you.
